Terms ofService

You must be at least 13 years old if you reside in the United States, or at least 16 years old if you reside elsewhere, to use the Services. If you are under 18, you may need parental or guardian consent depending on where you live. If you use Talkesy on behalf of an organization, you represent that you have authority to bind that organization.

You must provide accurate account information and keep credentials secure. Do not share your account. You are responsible for activity under your account. Notify us promptly at support@talkesy.com if you suspect unauthorized access.

A. Ownership

Your dictation input and the text Talkesy returns ("Customer Content") remain yours to the extent permitted by law. We do not claim ownership of your voice or the finished text pasted into your apps.

B. License to operate the Services

To provide dictation, cleanup, translation, dictionary, snippets, style, and related features, you grant Talkesy a worldwide, non-exclusive, royalty-free license to process Customer Content solely as needed to operate, secure, and improve the Services, consistent with our Privacy Policy and your settings.

C. AI features

The Services use speech recognition and language models to produce output. Output may be inaccurate or incomplete. You should review text before sending or relying on it. You are responsible for how you use Output.

D. No warranty on output

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKESY MAKES NO WARRANTIES REGARDING THE ACCURACY OF ANY OUTPUT. DO NOT RELY ON OUTPUT WITHOUT INDEPENDENT REVIEW WHERE ACCURACY MATTERS.

Subject to these Terms and any applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to install and use the Talkesy apps and access the Services for your personal or internal business productivity. We may update client software automatically. Open-source components included with the Software are governed by their own licenses where those licenses prevail.

Your use is also governed by our Acceptable Use Policy. Without limiting that policy, you agree not to:

• Reverse engineer, decompile, or attempt to extract source code or models except where prohibited restrictions are unenforceable.
• Circumvent security, authentication, word limits, licensing, or rate limits.
• Resell, sublicense, or provide the Services to third parties as your own product, or share credentials.
• Interfere with or disrupt the Services or other users.
• Use the Services to develop or train a competing speech or language model using Talkesy output.
• Record or transcribe others without required consent under applicable law.
• Engage in payment fraud or abusive refund/chargeback practices.

We may offer experimental or beta features. They may be less reliable. We may contact you for feedback. If a beta feature is designated confidential, do not disclose it without our permission.

The Services may rely on third parties (for example authentication providers, payment processors, cloud infrastructure, or AI providers). Those services have their own terms and privacy policies. Talkesy is not responsible for third-party services except as required by law.

The Services, branding, and related intellectual property are owned by Talkesy and protected by law. These Terms do not transfer ownership to you. Feedback you provide may be used by Talkesy without obligation to you.

Talkesy offers Free and paid plans (such as Pro and Premium) with word allowances and features described on our Pricing page. Paid subscriptions renew automatically until canceled, unless stated otherwise.

Taxes may apply. If you purchase through the Apple App Store or another platform store, that store's billing and cancellation rules apply. Otherwise, billing is handled by our payment processor under its terms. Fee changes for renewals will be communicated with reasonable notice where required.

Refunds are described in our Refund Policy.

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk of harm, fail to pay, or as needed to comply with law or protect the Services. Provisions that by nature should survive (including ownership, disclaimers, indemnity, and limitations of liability) will survive termination.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TALKESY DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SERVICES OR OUTPUT WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE CASES THEY APPLY ONLY TO THE EXTENT PERMITTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKESY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR OUTPUT. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

To the maximum extent permitted by law, you will indemnify and hold Talkesy and its team harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your Customer Content, or your breach of these Terms or applicable law, except to the extent caused by our breach of these Terms.

Before filing a formal claim, contact support@talkesy.com and allow sixty (60) days to attempt informal resolution. These Terms are governed by the laws applicable to Talkesy's principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise. Courts in that jurisdiction will have exclusive venue for disputes that are not subject to mandatory consumer venue rules. YOU MAY ONLY BRING CLAIMS INDIVIDUALLY, NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION, TO THE EXTENT SUCH WAIVER IS ENFORCEABLE.

We may update these Terms. We will update the date above and may provide additional notice for material changes. Continued use after changes take effect constitutes acceptance.
